어린 시절의 가장 소중한 기억은 무엇일까. 좋아하는 장난감을 가지고 놀던 순간이었을까, 아니면 친구들과 하루 종일 웃고 뛰놀며 아무 걱정 없이 지냈던 시간이었을까.

나에게 그 시절의 가장 빛나는 기억은, 한국 시골에서의 성장기였다. 나의 부모님은 대구·경북 남동부 지방에서 사과 과수원과 넓은 논을 경작하셨다. 과수원 뒤로는 한국전쟁 당시 가장 치열했던 전투지 중 하나로 손꼽히는 낙동강이 흐르고 있었고, 마을 앞에는 일제강점기부터 이어져 온 100년 된 사과밭이 자리 잡고 있었다. 이 땅은 단순한 생계 수단이 아니라 우리 가족의 세대가 지켜온 유산이자 뿌리였다.

이 지역의 논은 매우 비옥하여 한국에서도 손꼽히는 쌀 생산지로 성장했다. 박정희 독재 정권 시절, 이 마을 전체는 그린벨트 지역으로 지정되어 산업 개발이 엄격히 제한되고 농업 용도로만 보호되었다.

그러나 농민의 삶은 언제나 고단하다. 늘 빚을 안고 살아야 했고, 쉼 없는 노동이 일상이었다. 여름철이면 특히 힘들었다. 작물이 무르익기만을 기다리며 하늘을 걱정하고, 하루가 다르게 자라는 잡초와 싸워야 했다. 그럼에도 그 삶은 의미 있었고, 땅과 함께 살아간다는 감각은 나를 단단히 지탱해 주었다.

하지만 현진희 씨의 삶은 달랐다. 그녀는 제주에서 농사를 짓는 여성 농민이자 오랜 기간 사회운동에 헌신해온 활동가다. 전국여성농민회총연합 제주도연합 대정지회장을 맡고 있는 그는, 호박, 당근, 콜라비 등을 길러 가족과 이웃의 식탁을 책임졌다. 그런데 2025년 3월 27일, 현 씨는 징역 1년 8개월을 선고받고 농번기 밭일 중에 작업복 차림으로 구속되었다. 이후 그는 건강이 악화되었고, 막 태어난 손녀도 만나지 못한 채, 알츠하이머를 앓는 노모 역시 돌보지 못하고 있다.

그녀의 혐의는 사실상 벌금형에 해당하는 경미한 수준이었음에도, 제주지방법원 형사1부 오창훈 판사는 이를 중형으로 전환하고 즉시 구속을 명령했다.

재판 당일, 오 판사는 이렇게 말했다.

“지금부터 방청석에 있는 누구도 소리를 내지 마십시오. 움직이지 마십시오. 한숨 쉬지 마십시오. 항의하지 마십시오. 슬픔을 표현하지 마십시오. 심지어 무거운 숨조차 쉬지 마십시오. 오직 눈으로만 지켜보십시오. 이를 어기는 자는 즉시 이 법정에서 구속하겠습니다. 이 경고는 피고인과 변호인에게도 동일하게 적용됩니다.”

민주주의 국가의 법정에서 나올 수 있는 말인가. 하지만 이 발언은 2025년 3월 27일, 제주지법 형사1부 오창훈 판사가 실제로 방청객, 피고인, 변호인 모두에게 내린 경고였다.

그는 이 발언 직후 여성 노동자 한 명과 여성 농민 한 명에게 징역 1년 8개월을 선고하고 즉각 구속했다.

현진희 씨의 '범죄'는 무엇이었을까. 바로 억울하게 체포된 동료 농민에 대한 연대였다. 그녀는 기자회견에 참여하고 있었고, 경찰이 이를 강제로 해산하는 과정에서 저항하다 우발적으로 신체 접촉이 발생한 상황이었다. 이 기자회견은, 국가보안법 위반 혐의로 진술거부권을 행사했다는 이유로 구속된 제주 지역 진보 활동가에 대한 부당한 강제 구인을 규탄하기 위해 열린 자리였다.

경찰이 기자회견 참가자들을 끌어내는 과정에서 현 씨와 또 다른 활동가가 이를 막으려 하다가 충돌이 발생했다. 이 사건을 근거로 두 사람 모두가 기소되었고, 결국 가혹한 형벌을 받았다. 이 시위는 당시 윤석열 정권이 벌인 국가폭력에 대한 저항의 일환이었고, 전국농민회총연맹 사무총장이 국가보안법으로 구속된 사건과도 연결되어 있었다.

우리는 묻지 않을 수 없다. 왜 가혹한 판결은 항상 노동자와 농민에게만 내려지는가. 반면, 내란을 시도한 핵심 주범 윤석열은 여전히 석방된 상태로 특별검사 출석 조건을 ‘협상’하고 있는 상황이다. 현진희 씨는 즉각 석방되어야 한다.

시민사회는 현은정·현진희 두 활동가의 석방을 촉구하며 대법원에 판결 파기를 요청하고 있다. 아울러 오창훈 판사의 불법적이고 정치적으로 편향된 재판에 대한 윤리심사 청구도 함께 제기한 상태다.

두 사람에 대한 대법원의 최종 판결은 7월 3일로 예정되어 있다.

6월 3일 대선 당시 이재명 민주당 후보에게 임명받은 해외 동포 자문위원으로서, 이제 대한민국 대통령이 된 이재명 대통령에게 분명히 말하고자 한다.

대통령님, 현진희를 즉각 석방하십시오.

What would you say is the best part of your childhood memory? Was it playing with your favorite toys? Spending all day with friends, laughing and running free without a care in the world?

For me, it was growing up in rural Korea. My parents owned a large apple orchard and rice fields in the southeastern province of Daegu-Gyeongbuk. Just behind the orchard flowed the Nakdong River—famous as the site of one of the fiercest battles of the Korean War. In front of the village and the rice paddies stood our family’s 100-year-old apple orchard, a legacy deeply rooted in the land, tracing back even to the Japanese colonial era.

The rice paddies were so fertile that the area became one of Korea’s major rice-producing regions. In fact, under former President Park Chung-hee, the entire town was designated a Green Belt zone—protected exclusively for agriculture, with industrial development strictly prohibited.

Life for farmers is never easy—always in debt, always working. But there is something profoundly grounding in mixing one’s labor with the land. Summer was especially hard—waiting for the crops to ripen, worrying constantly about the weather, and battling weeds that grew faster than we could pull them. Still, it was a good life.

Not so for Jin-hee Hyun—a Korean farmer in Jeju and longtime activist—who, on March 27, was sentenced to one year and eight months in prison. Hyun, head of the Daejeong chapter of the Jeju branch of the Korean Women Peasants Association (KWPA), grows pumpkins, carrots, and kohlrabi to feed her family and neighbors. She was taken into custody straight from the fields during planting season—still in her work clothes. Since her imprisonment, she has suffered from health complications and has been unable to meet her newborn granddaughter or care for her mother, who suffers from Alzheimer’s disease.

Jeju District Court Judge Oh Chang-hoon converted what was essentially a fine-level offense into a prison sentence with immediate arrest.

"From this moment on, no one in the audience shall make a sound. Do not move. Do not sigh. Do not protest. Do not even express grief. Do not even breathe heavily. Watch only with your eyes. If anyone violates this, I will order immediate arrest in this courtroom. This warning applies equally to the defendants and their attorneys."

Surely, these cannot be the words of a judge in a democratic society. But they were. Spoken on March 27, 2025, by Judge Oh Chang-hoon of Jeju District Court Criminal Division 1—directed at courtroom spectators, the defendants, and even the defense attorneys.

Immediately after delivering this warning, Judge Oh sentenced a woman worker and a woman farmer to one year and eight months in prison and ordered their immediate detention.

Hyun’s alleged crime? Showing solidarity with a fellow farmer who had been arrested. She was accused of inflicting injury during a brief physical struggle with police who were attempting to forcibly disperse a press conference she was participating in. The event was organized outside Jeju Prison to protest the forced detention of a progressive activist who had been arrested under the infamous National Security Law—simply for exercising her right to remain silent.

As the police moved in, Hyun and another activist resisted being dragged away, resulting in an unintentional clash. On this basis, both were indicted. The demonstration was part of a broader resistance to state repression under then-President Yoon Suk-yeol, including the arrest of the National Farmers’ Union secretary general under the same draconian law.

Why are harsh verdicts reserved only for workers and farmers? Meanwhile, the ringleader of an attempted insurrection—Yoon Suk-yeol—remains free, negotiating the terms of his appearance before the Special Prosecutor. Hyun must be released immediately.

Civil society groups are demanding the release of Hyun Eun-jung and Jin-hee Hyun, urging the Supreme Court to overturn the ruling. They have also filed an ethics complaint against Judge Oh for conducting an unlawful and politically charged trial.

The final ruling on Hyun Eun-jung and Jin-hee Hyun is scheduled for July 3.
